“Platform” refers to the EGREEN ELD mobile application, website, and any associated software.

We reserve the right to modify these terms at any time. Any changes will be effective immediately upon posting on our website. Continued use of the Service after changes are posted will constitute acceptance of the revised terms.
4. Eligibility
By using our Service, you represent that you are at least 18 years of age and are legally allowed to enter into a binding contract. If you are using our Service on behalf of an organization, you agree to these terms on behalf of that organization.
5. User Responsibilities
Compliance with Laws: Users agree to comply with all applicable laws and regulations, including but not limited to transportation and safety laws.
Account Security: Users are responsible for maintaining the confidentiality of their account and password, as well as for all activities under their account.
Prohibited Conduct: Users agree not to misuse our Service, including but not limited to:
- Using the Service for illegal purposes.
- Interfering with or disrupting the Platform or any servers or networks connected to it.
- Circumventing, disabling, or otherwise tampering with security-related features of the Service.
6. Service License and Restrictions
We grant users a limited, non-exclusive, non-transferable, and revocable license to use our Service.
Users may not reverse-engineer, modify, or create derivative works based on the Service or any part of it, unless expressly permitted by us.

EGREEN ELD LLC collects data, including location and HOS information, to provide and enhance our services.

Users agree that we may use their data for purposes related to compliance, reporting, and service improvements.

All intellectual property, including but not limited to trademarks, logos, and copyrights associated with the EGREEN ELD Platform, is the exclusive property of EGREEN ELD LLC.
Users are prohibited from using our intellectual property without our express written permission.
9. Limitation of Liability
To the maximum extent permitted by law, EGREEN ELD LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to, loss of profits, loss of data, or other intangible losses.
Our liability, if any, shall be limited to the fees paid by the user for the Service during the three months prior to the date the cause of action arose, and only for the specific vehicle or driver involved in the incident.
10. Dispute Resolution
Governing Law: These terms and conditions are governed by and construed in accordance with the laws of Virginia.
Arbitration: Any disputes arising from or relating to these terms shall be resolved through binding arbitration in Ashland, Virginia, except where prohibited by law.
Waiver of Class Action: Users agree to waive any right to participate in class action lawsuits or class-wide arbitration.
11. Termination
We reserve the right to terminate or suspend access to our Service immediately, without prior notice, if a user breaches these Terms of Service.
Users may terminate their account at any time by notifying EGREEN ELD LLC in writing.
